A BAA is a contract with a business associate — an outside company that creates, receives, or stores PHI on your behalf. With Kimitsu, no such company exists: audio, transcripts, and notes are processed and stored only on your Mac, and we operate no server that could ever see them. No PHI changes hands, so there is no business associate — and nothing to sign. It’s the same reason you don’t have a BAA with Microsoft for a note you type in Word and save to your desktop.
To be precise: HIPAA compliance is a property of your practice, not of any single tool. Kimitsu removes the vendor-risk half of the equation entirely; securing the Mac itself (FileVault, a strong password — see below) remains your half. Yes — treat it as non-negotiable. Recording consent sits between you and your client, not with us: a number of U.S. states require all-party consent to record a conversation, and most ethics codes expect written informed consent regardless of state law. Kimitsu is a recorder like any other and doesn’t change that.
If you’d rather never record clients, you don’t have to. Two of the four input modes never capture a client’s voice: dictate a two-minute recap after the session, or type a few scrappy bullets. Same note out — no consent question to ask.
Turn on FileVault (System Settings → Privacy & Security) and everything Kimitsu stores is encrypted at rest — without your login password the disk is unreadable, and Find My can erase the Mac remotely. That’s the standard trio we’d recommend to any clinician: FileVault, a strong password, Find My.
Kimitsu shrinks the blast radius further on its own: clients exist only as a pseudonym and a color — no name, DOB, or diagnosis fields to expose — and if you use the auto-delete timers, older audio and transcripts are already gone.
No and no. Kimitsu runs two models on your Mac’s own chip: Apple’s built-in model, and an optional stronger one you download once. There is no OpenAI, no API, no cloud inference — and nothing to train on, because nothing is ever uploaded. With Wi-Fi off, notes still get written.
